Once an offer is made and accepted, both parties have already agreed to binding terms, often referred to as a reservation agreement, that makes the offer legally binding. This ensures that neither party can back out without facing penalties.
The buyer is required to pay a non-refundable reservation fee, which shows their commitment to the purchase. This fee is typically held in escrow and is not deducted from the final sale price.
The process comes with a fixed timeline, requiring both parties to complete the transaction within a specified period (e.g., 28 -58 or 90 days). These timescales can be extended, with no penalties for vendors.
Gazumping: When a seller accepts a higher offer after agreeing to sell to someone else. Gazundering: When a buyer lowers their offer just before exchanging contracts. These risks are minimized because the offer is contractually committed.
Both parties have peace of mind knowing the sale is more likely to go through without complications, making it appealing in competitive markets or probate sales.
